1. Introduction

These Terms and Conditions govern your access to and use of the SmartFix Dubai website and your enquiries, quotation requests, site-visit requests and service orders submitted to SmartFix Dubai.

By using this website, submitting an enquiry, requesting a site visit, accepting a quotation or instructing SmartFix Dubai to begin work, you confirm that you have read and accepted these Terms and Conditions.

If you do not agree with these Terms, you should not use the website or place an order with SmartFix Dubai.

2. About SmartFix Dubai

In these Terms, “SmartFix,” “SmartFix Dubai,” “we,” “us” and “our” refer to the legal entity identified above.

“Customer,” “you” and “your” refer to the individual, company, property owner, tenant, contractor, consultant or authorised representative requesting or purchasing our services.

3. Website Purpose

The SmartFix Dubai website provides information about our aluminium, glass, door and outdoor-structure services.

Website content is intended to help customers understand the general types of systems and services that may be available. It does not constitute a final technical specification, binding quotation, engineering approval, product guarantee or confirmation that a particular system is suitable for a specific property.

A binding service order is created only when:

  1. SmartFix issues a written quotation or contract;
  2. the customer accepts it in the required manner;
  3. any required deposit or advance payment is received; and
  4. SmartFix confirms the order.

4. SmartFix Services

Depending on current availability and the agreed project scope, SmartFix services may include:

  • Automatic door installation and repair support
  • Aluminium and glass sliding doors
  • Telescopic sliding door systems
  • Slim profile sliding, bifold and swing doors
  • Concealed and hidden door systems
  • Glass partition systems
  • Glass rooms and outdoor enclosures
  • Aluminium pergola systems
  • Glass skylights and roof-glazing systems
  • Site measurement and technical assessment
  • Fabrication, supply and installation
  • Inspection, adjustment and maintenance support

The exact products, materials, components and services included in a project will be stated in the relevant quotation.

5. Website Enquiries

Submitting an enquiry through the website, WhatsApp, telephone, email or social media does not create a binding order.

Any initial guidance provided before a site assessment is based on the information, photographs, videos and approximate measurements supplied by the customer. Such guidance may change following physical inspection and accurate measurement.

Customers should not rely on preliminary messages as final technical advice or pricing.

6. Site Visits and Assessments

SmartFix may require a site visit before preparing or confirming a quotation.

During a site visit, SmartFix may assess:

  • Opening or area dimensions
  • Existing walls, floors, ceilings or roofs
  • Structural surroundings
  • Access conditions
  • Fixing locations
  • Existing electrical or access-control connections
  • Glass, frame and finishing requirements
  • Installation restrictions
  • Property-management requirements
  • Health and safety conditions

A site visit does not guarantee that the proposed system is technically feasible.

Where a site-visit charge applies, the amount and whether it is refundable or adjustable against a confirmed order will be stated before the visit is booked.

7. Customer-Supplied Information

The customer is responsible for ensuring that all information supplied to SmartFix is accurate and complete.

This includes:

  • Property address
  • Customer contact details
  • Measurements supplied before a site visit
  • Photographs and videos
  • Drawings and floor plans
  • Structural information
  • Building-management requirements
  • Access restrictions
  • Electrical information
  • Existing system details
  • Ownership or tenancy status

SmartFix is not responsible for additional costs or delays resulting from inaccurate, incomplete or misleading information supplied by the customer or another person acting on the customer’s behalf.

8. Quotations

All quotations are based on the information available at the time they are prepared.

A quotation should identify, where applicable:

  • Product or system type
  • Approximate or confirmed dimensions
  • Materials and finishes
  • Glass specification
  • Aluminium profile or system
  • Hardware and accessories
  • Installation scope
  • Exclusions
  • Price
  • VAT treatment
  • Payment schedule
  • Estimated programme
  • Quotation validity
  • Warranty or after-sales terms

A quotation is valid only for the period stated in it.

SmartFix may revise a quotation if:

  • Measurements change;
  • the site condition differs from the information originally provided;
  • the customer changes the design or specification;
  • additional work becomes necessary;
  • supplier pricing changes after the quotation expires; or
  • an error or omission is identified before order confirmation.

9. Order Confirmation

An order is not confirmed until SmartFix has received:

  • Written acceptance of the quotation;
  • confirmation of the final specifications;
  • any required deposit or advance payment; and
  • any required customer or property approvals.

SmartFix may decline or withdraw a quotation before order confirmation.

Once an order is confirmed, the quotation, approved drawings, written change orders, invoices and these Terms will form the agreement between SmartFix and the customer.

10. Prices and VAT

Prices will be stated in UAE dirhams unless otherwise specified.

The quotation or invoice will state whether VAT is included or added separately.

Only the products and services expressly listed in the quotation are included in the price. Any additional work, product, component, access equipment, electrical connection, structural modification, finishing work or authority requirement will be charged separately unless expressly included.

11. Payment Terms

The customer must make payments according to the schedule stated in the quotation or invoice.

Depending on the project, payments may include:

  • Site-visit or assessment fee
  • Design or survey fee
  • Deposit
  • Material or fabrication payment
  • Progress payment
  • Installation payment
  • Final payment upon testing or handover

SmartFix is not required to procure materials, begin fabrication, schedule installation or continue work while an amount is overdue.

The customer may be responsible for reasonable costs incurred by SmartFix in recovering overdue amounts, subject to applicable law.

12. Deposits

Deposits may be required for custom-made, specially ordered or fabricated products.

The quotation must state:

  • the deposit amount;
  • when it is payable;
  • what stage of work it authorises; and
  • whether any part may become non-refundable after procurement or fabrication begins.

Nothing in this clause removes any mandatory right available to the customer under applicable UAE law.

13. Cancellations and Refunds

Cancellation requests must be submitted in writing.

Because many SmartFix systems are measured, ordered or fabricated specifically for an individual property, cancellation may result in charges for work already completed, materials ordered, supplier commitments, transportation, design work or fabrication undertaken.

Once custom fabrication or special procurement has begun, amounts relating to completed work or non-returnable materials may not be refundable, subject to the quotation and applicable law.

Any refund approved by SmartFix will be calculated after deducting properly incurred costs and will be processed using an agreed payment method.

14. Changes to the Project

Any change requested after order confirmation may affect:

  • Price
  • Material requirements
  • Fabrication
  • Lead time
  • Installation date
  • Technical feasibility
  • Warranty
  • Approval requirements

Changes must be documented and accepted in writing.

SmartFix is not required to carry out additional or changed work until the revised scope, price and schedule have been approved.

Verbal requests made to installers or site workers will not amend the agreed scope unless subsequently confirmed in writing by an authorised SmartFix representative.

15. Measurements and Fabrication

Final fabrication dimensions will normally be based on measurements taken or approved by SmartFix.

Where the customer instructs SmartFix to fabricate from customer-supplied dimensions, drawings or specifications without an independent SmartFix measurement, the customer assumes responsibility for their accuracy.

Custom fabrication may begin only after the required dimensions, design and system specification have been confirmed.

Reasonable manufacturing and installation tolerances may apply to aluminium, glass, hardware, seals, finishes and adjoining construction.

16. Materials and Product Specifications

SmartFix will supply materials and components described in the approved quotation.

Product samples, photographs, website images, renders and colour displays are illustrative. Actual products may show reasonable variations in:

  • Colour
  • Shade
  • texture
  • frame appearance
  • glass tint
  • reflections
  • hardware details
  • joint positions
  • seal appearance
  • manufacturing finish

Where an identified product, component or finish becomes unavailable, SmartFix will discuss an alternative with the customer before substitution.

No specific frame width, motor brand, glass performance, acoustic rating, thermal value, maximum span or load capacity applies unless it is expressly stated in the approved quotation or technical specification.

17. Glass

Glass type, thickness, finish and performance will be stated in the approved specification where relevant.

Potential options may include clear, tinted, frosted, laminated, tempered, low-emissivity or double-glazed glass. The availability and suitability of each option depend on the selected system and application.

Glass can contain visual characteristics permitted within relevant manufacturing standards, including minor distortions, reflections, marks, inclusions or colour variations.

The customer must report apparent glass damage before handover or immediately after discovering it.

18. Installation Dates and Delays

Any installation date or completion period provided before final confirmation is an estimate unless expressly agreed as a fixed contractual date.

The programme may be affected by:

  • Material availability
  • Supplier delays
  • Manufacturing requirements
  • Site readiness
  • Access restrictions
  • Building-management approvals
  • Authority approvals
  • Adverse weather
  • Customer changes
  • Existing structural conditions
  • Electrical readiness
  • Events outside SmartFix’s reasonable control

SmartFix will inform the customer of material changes to the programme where reasonably possible.

19. Customer Site Responsibilities

The customer must provide:

  • Safe and timely access to the property
  • A clear working area
  • Suitable parking and loading access where reasonably required
  • Permission to enter and carry out the work
  • Access to electricity and other agreed utilities
  • Accurate site-contact information
  • Required building-management permissions
  • Information about concealed cables, pipes or services
  • A safe environment for SmartFix staff and contractors

Additional attendance, storage, transport or rescheduling costs may apply where installation cannot proceed because the site is inaccessible, unsafe or not ready.

20. Property Approvals and Permits

The customer is responsible for obtaining approvals from the property owner, landlord, developer, owners’ association, building management or relevant authority unless the quotation expressly states that SmartFix will handle a particular approval.

This may apply to:

  • Rooftop glass rooms
  • Pergolas
  • Skylights
  • Balcony enclosures
  • External façade alterations
  • Structural openings
  • Electrical works
  • Commercial entrance modifications

General guidance from SmartFix does not constitute legal, engineering or regulatory approval.

21. Existing Structures and Hidden Conditions

SmartFix quotations are based on visible and reasonably identifiable site conditions.

During installation, previously hidden conditions may be discovered, including:

  • Weak or damaged substrates
  • Concealed services
  • Water damage
  • Uneven surfaces
  • inadequate structural support
  • existing waterproofing failures
  • undocumented electrical systems
  • unsuitable previous work

SmartFix will notify the customer if additional work or specialist assessment is required.

Additional work will be quoted separately unless it is already included in the agreed scope.

22. Electrical and Access-Control Work

Automatic doors, motorised pergolas, opening skylights and access-control systems may require electrical, control or network connections.

The quotation will state whether SmartFix’s scope includes:

  • Operators or motors
  • Sensors
  • Control units
  • Push buttons
  • Card readers
  • Keypads
  • Cabling
  • Power supplies
  • Programming
  • Integration with existing systems

SmartFix is not responsible for the performance of existing third-party systems unless their inspection, repair or integration is expressly included.

23. Subcontractors and Suppliers

SmartFix may use qualified suppliers, fabricators, technicians or subcontractors to perform parts of the project.

SmartFix remains responsible for the work it has contractually agreed to provide, subject to these Terms and applicable law.

Manufacturer or supplier warranties may apply separately to certain components.

24. Testing and Handover

At completion, SmartFix may inspect or test the installed system for matters such as:

  • Alignment
  • Opening and closing action
  • Panel movement
  • Sensor operation
  • Track movement
  • Motor operation
  • Hardware function
  • Seal condition
  • General fit and finish

The customer or authorised representative should inspect the work at handover and notify SmartFix of any visible concern.

Handover does not prevent the customer from reporting a latent defect that could not reasonably have been identified during the initial inspection.

25. Defects and Service Concerns

The customer should notify SmartFix of a suspected defect or service issue as soon as reasonably possible.

The notice should include:

  • Customer name
  • Project address
  • Invoice or quotation reference
  • Description of the problem
  • Photographs or videos
  • Date the issue was discovered

SmartFix must be given a reasonable opportunity to inspect an alleged defect before another contractor alters or repairs the system.

Emergency measures taken to protect people or property should be proportionate and documented where possible.

26. After-Sales Support

SmartFix provides inspection, adjustment and maintenance support for systems supplied and installed by SmartFix, subject to the quotation and applicable warranty terms.

After-sales support may include:

  • Alignment checks
  • Track and roller inspection
  • Sensor or operator assessment
  • Hardware inspection
  • Sealant checks
  • Adjustment
  • Maintenance guidance

Support for systems supplied or installed by third parties is subject to separate inspection and acceptance by SmartFix.

27. Warranty

Any applicable warranty period, covered components, exclusions and claim procedure must be stated in the quotation, invoice, handover document or separate warranty certificate.

Unless otherwise confirmed in writing, warranty coverage may exclude issues caused by:

  • Misuse or negligence
  • Accidental or deliberate damage
  • Unauthorised alteration
  • Work carried out by another contractor
  • Failure to follow operating or maintenance instructions
  • Normal wear and tear
  • Building movement
  • Defective surrounding construction
  • Water ingress originating outside SmartFix’s agreed scope
  • Electrical supply faults
  • Third-party system failures
  • Failure to obtain required maintenance

No warranty clause will exclude rights that cannot lawfully be excluded.

28. Website Content

SmartFix aims to keep website information accurate and current. However, product availability, images, specifications, descriptions and service coverage may change.

Website content should not be treated as a substitute for:

  • A site assessment
  • An approved quotation
  • A technical drawing
  • A structural assessment
  • A manufacturer specification
  • Regulatory approval

SmartFix may update or remove website content without prior notice.

29. Intellectual Property

Unless otherwise stated, the SmartFix Dubai name, logo, website design, text, graphics, photographs, videos, drawings and other original website materials are owned by or licensed to SmartFix.

You may view and print website content for personal or internal business reference.

You may not reproduce, republish, sell, modify, distribute or commercially exploit SmartFix content without prior written permission.

30. Project Photography

SmartFix will not publish identifiable photographs or videos of a private customer’s property as a completed project without appropriate permission.

Where the customer agrees to project photography, the agreed permission should state whether SmartFix may use the material on:

  • Its website
  • Social media
  • Marketing documents
  • Proposals
  • Portfolio materials
  • Digital advertising

Customers should inform SmartFix in writing of any privacy, security or identification restrictions before photography takes place.

31. Prohibited Website Use

You must not use the website:

  • For unlawful or fraudulent activity
  • To transmit malicious software
  • To interfere with website security

  • To impersonate another person
  • To collect website data without authorisation
  • To infringe intellectual-property rights

SmartFix may restrict access where misuse is suspected.

32. Privacy and Personal Data

Personal information submitted through the website, WhatsApp, email, telephone or service process will be handled according to the SmartFix Privacy Policy and applicable data-protection requirements.

The Privacy Policy should explain:

  • Why it is collected
  • How it is used
  • Who it may be shared with
  • How long it may be retained
  • The customer’s data rights
  • How privacy requests may be submitted

The Privacy Policy forms part of these Terms but remains a separate website document.

33. Cookies

The SmartFix website may use necessary, functional, analytics or marketing cookies.

Where required, users will be given appropriate information or choices through the website’s cookie notice or consent tool.

Further information should be provided in the Privacy Policy or a separate Cookie Policy.

34. Third-Party Links and Platforms

The website may contain links to external websites or platforms, including WhatsApp, maps, social media services and payment or communication providers.

SmartFix does not control third-party platforms and is not responsible for their availability, content, security or privacy practices.

Use of a third-party platform is subject to that provider’s terms and policies.

35. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Subject to applicable law, SmartFix will not be responsible for indirect or consequential losses that were not reasonably foreseeable when the order was confirmed.

SmartFix will not be responsible for loss resulting from:

  • Inaccurate information supplied by the customer
  • Unauthorised alteration by another person
  • Defects outside SmartFix’s agreed scope
  • Existing structural or waterproofing failures
  • Third-party products or systems not supplied by SmartFix
  • Customer failure to obtain approvals
  • Customer misuse or lack of maintenance
  • Events outside SmartFix’s reasonable control

This clause does not remove SmartFix’s responsibility to provide services in accordance with the agreed specifications and applicable consumer-protection requirements.

36. Force Majeure

SmartFix will not be liable for delay or failure caused by an event outside its reasonable control.

Such events may include:

  • Extreme weather
  • Fire or flooding
  • Government restrictions
  • Authority delays
  • Labour disruption
  • Transport in
  • Supplier shutdown
  • Material shortages
  • Utility failure
  • Civil disturbance
  • Public-health emergencies

SmartFix will take reasonable steps to reduce the effect of the delay and resume the affected work when reasonably possible.

37. Suspension or Termination

SmartFix may suspend or terminate work where:

  • Required payments remain overdue
  • The site is unsafe
  • Access is repeatedly denied
  • Required approvals are not available
  • The customer materially breaches the agreement
  • Continuing the project would be unlawful
  • The customer or another person threatens or abuses SmartFix personnel

Termination will not remove the customer’s obligation to pay for properly completed work, ordered materials and committed project costs, subject to applicable law.

38. Complaints

Customers should first raise complaints directly with SmartFix.

Please provide the project reference, property address, description of the issue and supporting photographs or videos.

SmartFix will review the matter and aim to provide a response or proposed next step within a reasonable period.

Customers retain the right to contact the relevant UAE consumer-protection authority where a complaint cannot be resolved directly.

39. Governing Law and Jurisdiction

These Terms and any agreement between SmartFix and the customer are governed by the laws of the United Arab Emirates and the applicable laws of the Emirate of Dubai.

Subject to any mandatory consumer right or dispute procedure, the courts of Dubai will have jurisdiction over disputes arising from these Terms or SmartFix services.

40. Changes to These Terms

SmartFix may update these Terms to reflect changes in its services, website, business practices or legal obligations.

The updated version will be published on the website with a revised “Last Updated” date.

Terms applying to an already confirmed project will not normally be changed retrospectively unless required by law or agreed in writing.

41. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

Any invalid provision will be interpreted or adjusted only to the minimum extent necessary to make it lawful and enforceable.

42. No Waiver

A delay or failure by SmartFix to enforce a contractual right does not mean that the right has been waived.

A waiver is effective only when confirmed in writing by an authorised SmartFix representative.

43. Entire Agreement

The accepted quotation, approved specifications, written variations, invoices, these Terms and any applicable warranty document form the complete agreement between SmartFix and the customer.

If there is a conflict, the following order should apply unless otherwise stated:

  • A signed project contract;
  • Written and approved project variations;
  • The accepted quotation and specifications;
  • The applicable warranty document;
  • These Terms and Conditions;
  • General website content.
